Madras High Court Defers Plea to Halt ‘Parasakthi’ Release, Seeks Report From Writers’ Body

A last-minute attempt to stop the release of the Tamil film Parasakthi did not immediately find favour with the Madras High Court on Thursday. The court chose not to grant an urgent injunction but kept the dispute alive, directing further examination of the writer’s complaint before taking a call. The matter came up before Justice S. M. Subramaniam, who heard the parties briefly in a packed courtroom.

Background

The applicant, K.V. Rajendran alias Varun Rajendran, has moved the court alleging that the film Parasakthi infringes his creative rights. He sought an ad-interim order restraining the producer, Dawn Pictures Private Limited, from releasing or continuing the screening of the film in theatres, on television, or on OTT platforms anywhere in the world, including dubbed or remade versions.

On the other side are the film’s director Sudha Kongara, along with writers Arjun Nadesan and Mathimaran Pugazhendhi. The South Indian Film Writers Association (SWAN) has also been drawn into the dispute, given its role in handling complaints relating to authorship and originality within the industry.

Court’s Observations

At this early stage, the bench appeared cautious. Senior counsel for the director and the production house entered appearance and took notice of the proceedings. The judge did not go into the merits of the plagiarism claim or the similarities alleged by the applicant.

Instead, the court charted out a short procedural course. “Notice to the remaining defendants is necessary before any interim relief is considered,” the bench indicated in substance, making it clear that a blanket restraint on release could not be passed without hearing all sides.

Importantly, the court asked SWAN to step in. The writers’ body has been directed to examine the complaint filed by the applicant, hear all concerned parties, and place a report before the court. This, the judge suggested, would assist in understanding whether the dispute is essentially about creative overlap or something more serious.

Decision

Recording the submissions, the Madras High Court declined to grant an immediate injunction against the release of Parasakthi. Notices were ordered to the remaining respondents, with the matter posted for further hearing on January 2, 2026. SWAN has been directed to complete its examination and submit a report by that date, after which the court will take a fresh look at the request for relief.
